Weatherwise Terms of Service

These terms cover the Weatherwise weather app, its hosted forecast service and the optional Android launcher. By selecting Get started in the app, or by using Weatherwise, you agree to these terms. If you do not agree, do not use Weatherwise.
Using Weatherwise
Weatherwise presents forecasts, radar and forecast maps, activity suggestions and links to government news. You may use the weather app without choosing Weatherwise as your default home app. The launcher changes the screen reached by the Android Home action only after you select it in Android's chooser. You may switch back in your device's default-app settings.
The first launcher version supports personal-profile app discovery and opening. Work-profile apps, private space, folders and widgets are not supported. If you make Weatherwise your home app, keep your previous home app installed so you can switch back to it.
Forecasts and activity suggestions
Weather changes and information may be delayed, unavailable, incomplete or inaccurate. Past radar and satellite images show observations; future radar and forecast maps depict model or forecast output, not a guaranteed outcome. Activity suggestions describe expected comfort using forecast inputs. They are not a guarantee of safe travel or outdoor conditions. Don't use Weatherwise as the sole basis for decisions about personal safety or other safety-critical activities. Check official warnings and local conditions, and follow emergency instructions. Weatherwise's daily reminder is not a severe-weather warning service.
Optional permissions and accounts
Location, notifications and launcher selection are optional and can be changed in device settings. Manual-city weather remains available when location is declined.
Weatherwise creates an anonymous account on first launch so its forecast service can limit use. Signing in with Google is optional; it lets you save up to 10 places and keep your settings on another phone. You can sign out, or delete your account in the app, at any time. The service applies usage limits to each account and network, and some features pause until a limit resets.
Advertising and subscriptions
This version shows no ads. If a later version shows ads, they will be labeled as ads, so you can tell them apart from app controls, weather information and news.
Weatherwise Plus is an optional subscription sold through Google Play. It renews automatically until you cancel it in Google Play. Prices, and any free trial you qualify for, are shown by Google Play before you confirm. Plus features depend on the store confirming your purchase to Weatherwise. Deleting your Weatherwise account does not cancel a subscription. Neither does uninstalling the app. To cancel, open your subscriptions in the Google Play Store, or in Weatherwise tap Weatherwise Plus on the Today screen, then Manage subscription. After you cancel, Plus stays active until the end of the current subscription period. Except where the law requires otherwise, we do not refund partial subscription periods; Google Play may grant refunds under its own policies, and a refund may end Plus right away.
Acceptable use and third-party services
Use the service lawfully. Do not attempt to bypass access controls or usage limits, abuse provider quotas, extract credentials, or interfere with the service. Forecasts, maps, news and advertising may be supplied by third parties and remain subject to applicable provider and intellectual-property rights. An article link does not transfer ownership of the publisher's content or imply our endorsement. Weatherwise is independent and not affiliated with or endorsed by NOAA, the National Weather Service or Iowa State University.
Availability and changes
Weatherwise depends on its hosted service and on third-party providers, which may be delayed, limited or unavailable. Official alerts and past radar come directly from the National Weather Service and NOAA and do not depend on our service. Features, providers, limits and experiments may change as the product develops. Do not rely on uninterrupted availability. You can stop using Weatherwise at any time. We may suspend or end your access if you break these terms, if the law requires it, or to protect the service. When your account is deleted or your access ends, your information is handled as the Privacy Policy describes.

Eligibility
You must be at least 13 years old to use Weatherwise. If you are under the age of adulthood where you live (18 in most U.S. states), you may use Weatherwise only with the permission of a parent or guardian who agrees to these terms for you.
Warranty and liability
Weatherwise is provided "as is" and "as available." To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement, and we do not promise that Weatherwise or its forecasts will be accurate, timely, uninterrupted or error-free. To the extent the law allows, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, arising from Weatherwise or these terms, and our total liability for all claims relating to Weatherwise is limited to the amount you paid for Weatherwise Plus in the 12 months before the claim arose. Nothing in these terms limits rights you have under law that cannot be waived.
Disputes
Instead of going to court, you and we agree to resolve any dispute about Weatherwise or these terms by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either of us may bring a qualifying claim in small claims court. This agreement to arbitrate is governed by the Federal Arbitration Act. You and we give up the right to a jury trial and to take part in a class or representative action. Before starting arbitration, you agree to email support@goweatherwise.com and give us 30 days to try to resolve the dispute informally.
Governing law
These terms are governed by the laws of the State of North Carolina and applicable U.S. federal law, without regard to conflict-of-laws rules. Except where these terms say otherwise, any claim relating to Weatherwise or these terms must be brought in the state or federal courts located in North Carolina, and you and we agree to their jurisdiction. If you are a consumer, this does not take away the protection of laws where you live that cannot be waived by agreement. If any part of these terms is found unenforceable, the rest stays in effect.
